1. Acceptance of Terms

By accessing and using GuardianAI ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

GuardianAI is a software tool designed to assist in EU AI Act compliance analysis. The Service does not constitute legal advice. Results provided are for informational and decision-support purposes only.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.

4. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of GuardianAI and its licensors. You retain all rights to documentation you upload to the Service.

5. Limitation of Liability

In no event shall GuardianAI, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain and the European Union, without regard to its conflict of law provisions.

7. Important Notice: Informational Nature of the Service

GuardianAI is exclusively an informational support tool. The analyses, reports and classifications generated by the Service are produced by automated artificial intelligence and do not constitute legal, regulatory or compliance advice under any circumstances.

  • •Possibility of errors: Automated AI analysis may contain inaccuracies, omissions or incorrect interpretations. Results have not been verified by legal professionals and may not reflect the current state of applicable regulation.
  • •No liability for decisions: GuardianAI assumes no liability for business, strategic, legal or any other decisions that the user makes based on the Service's results, whether in whole or in part.
  • •Mandatory professional validation: Before making regulatory compliance decisions with significant legal, regulatory or financial implications, it is expressly recommended to consult with a qualified lawyer or compliance expert.
  • •Regulatory evolution: The EU AI Act and associated regulations are subject to change. GuardianAI does not guarantee that its knowledge base is updated in real time.

Use of the Service implies acceptance of these conditions. If you disagree, you should not use GuardianAI to support decisions with legal consequences.

8. Billing, Payments and Trial Period

By subscribing to a paid plan, you accept the following billing conditions:

  • •Free trial period: Starter, Pro and Business plans include a 7-day free trial. No charges will be made during this period. After 7 days, the plan amount will be billed automatically unless you cancel before the trial ends.
  • •Billing cycle: Subscriptions are billed monthly or annually, depending on the option selected at the time of purchase. Each invoice is generated at the start of the next billing period.
  • •Plan changes: When upgrading, a prorated charge for the price difference will be generated immediately for the remaining period of the current cycle; access to the new plan is immediate. When downgrading, no refund or credit is issued for unused time; the lower price will apply from the next billing cycle, although access to the lower plan is activated immediately.
  • •Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to the services until the end of the already-paid billing period. No refunds will be issued for unused time after the cancellation date.
  • •Taxes: Prices shown may not include applicable taxes (VAT or other). Taxes will be added to the final invoice in accordance with the legislation in force in your jurisdiction.

9. Refund Policy

As a general rule, GuardianAI does not accept refunds. By subscribing to any of our plans, you expressly accept this policy as an essential condition of the service.

  • •No refund for cancellation: Cancellation of an active subscription does not entitle you to any refund for the period already billed, including the current month or year.
  • •No refund for plan change: Changing to a lower-priced plan (downgrade) does not generate credit or refund for unused time on the previous plan.
  • •No refund for partial use: Refunds are not accepted for partial use of the service, for not using certain features of the subscribed plan, or for general dissatisfaction with the service.

Exceptions (sole and limited): Exceptionally, and at GuardianAI's sole discretion, a refund may be considered only in the following cases:

  • 1.Severe technical failure attributable to GuardianAI: The service has been completely inaccessible for a continuous period exceeding 72 hours due to causes directly attributable to GuardianAI (excluding third-party provider outages, scheduled maintenance or force majeure), and the user can prove the harm caused.
  • 2.Duplicate charge or billing error: A duplicate charge or material billing error directly attributable to GuardianAI has occurred. In such case, only the excess amount charged will be refunded.
  • 3.Applicable legal obligation: The legislation of your country of residence expressly grants you the right of withdrawal or another refund right that cannot be contractually excluded. In such case, the refund will be limited to the legally required minimum.

To request a refund in any of the exceptional cases above, you must contact us at contact@guardian-ai.online within 14 calendar days of the charge, providing documentation supporting the claimed case. GuardianAI will resolve the request within a maximum of 15 business days. A favorable resolution does not set a precedent for future situations.
